Abstract

The research on the problems of procurement from online sellers in the Public Procurement and Supplies Administration Act, B.E. 2560 : A case study of procurement by specific methods has the following objectives: to study the problem situations that arise in procurement from online sellers and to propose procurement measures from online sellers by using document research methods. Based on the result of this research, it was found that procurement from online sellers does not have a process that complies with the Ministry of Finance Regulations on Government Procurement and Supplies Management, B.E. 2560, as follows : 1) Setting the finance limit 2) making a written agreement 3) offering the price from the online seller in a specific case 4) Payment in advance 5) checking and receiving parcels, and 6) the requirements of the online seller, so the problem can be divided into two main issues : the first issue is from the government agencies discussions with the Government Procurement and Supplies Management Problem Determination Committee, and the second issue is a problem in the procurement process from online seller providers according to the Ministry of Finance Regulations on Government Procurement and Supplies Management B.E. 2560, and this problem has not been solved at the present. Therefore, the researcher recommended proposing additional amendments to allow online procurement to be carried out in accordance with the Public Procurement and Supplies Administration Act, B.E. 2560, by issuing a secondary law as an amendment to the criteria for online procurement that can be carried out in accordance with the Ministry of Finance Regulations on Government Procurement and Supplies Management, B.E. 2560.
