การศึกษาวิเคราะห์ข้อห้ามตามหลักการอุศูลุลฟิกฮฺในสูเราะฮฺอัลฮุญุร๊อต

Abstract

การวิจัยครั้งนี้มีวัตถุประสงค์ คือ 1) เพื่อศึกษาความเป็นมาและความสำคัญของสูเราะฮฺ อัลฮุญุร๊อต 2) เพื่อศึกษาความหมายและความสำคัญของข้อห้ามตามหลักการอุศูลุลฟิกฮฺ 3) เพื่อศึกษาวิเคราะห์ข้อห้ามตามหลักการอุศูลุลฟิกฮฺในสูเราะฮฺอัลฮุญุร๊อต การวิจัยนี้ได้ใช้ระเบียบวิธีวิจัยเชิงพรรณนาบรรยายโดยใช้หลักการของอุศูลุลตัฟสีร อุศูลุลฮะดีษ อุศูลุลฟิกฮฺ ตลอดจนหลักไวยากรณ์ภาษาอาหรับ อัลบะลาเฆาะฮฺ และนะฮู

ผลการวิจัยพบว่า 1) สาเหตุแห่งการประทานอายะฮฺอัลกุรอานในสูเราะฮฺอัลฮุญุร๊อตนั้น เกี่ยวข้องกับพฤติกรรมต้องห้ามของมนุษย์ในด้านอัคล๊าค (มารยาท) ในอิสลาม เช่น ห้ามล้ำหน้าอัลลอฮฺและ เราะสูลของพระองค์ในกิจการงานต่าง ๆ ห้ามพูดเสียงดังต่อหน้าท่านเราะสูล ห้ามดูถูกเหยียดหยามซึ่งกันและกัน ห้ามตั้งฉายา ห้ามการนินทา ห้ามสอดแนม และห้ามทวงบุญคุณ 2) สำนวนโวหารการห้ามที่ปรากฏอยู่ในอัลกุรอานและฮะดีษนั้น (เฉพาะฮะดีษที่เกี่ยวข้อง) มีทั้งฮะกีกีย์และมะญาซีย์ ซึ่งมิได้หมายความว่า สำนวนการห้ามที่ปรากฏอยู่ในอัลกุรอานและฮะดีษ คือสิ่งต้องห้ามกระทำอย่างเด็ดขาดเสมอไป เรียกว่า “ฮะรอม” ซึ่งในเวลาเดียวกันสำนวนการห้ามที่ปรากฏอยู่ในอัลกุรอานและฮะดีษ อาจหมายถึงสิ่งที่ต้องห้ามกระทำอย่างไม่เด็ดขาด เรียกว่า “มักรูฮฺ” 3) การล้ำหน้าอัลลอฮฺและเราะสูลของพระองค์ในกิจการงานต่าง ๆ ฮุกมฮะรอม การพูดเสียงดังต่อหน้าหรือลับหลังท่านเราะสูลฮุกมมักรูฮฺ การดูถูกเหยียดหยามซึ่งกันและกันฮุกม ฮะรอม การตั้งฉายาให้กันเป็นสิ่งที่ไม่อนุญาต ส่วนการตั้งฉายาที่บุคคลนั้นชื่นชอบถือว่าเป็นที่อนุญาต การสอดแนมเพื่อเปิดโปงข้อบกพร่องของผู้อื่นให้ได้รับความเสื่อมเสียฮุกมฮะรอม และมีข้อยกเว้นหากส่งผลให้เกิดประโยชน์อันสูงสุด การนินทาฮุกมฮะรอม และมีข้อยกเว้นบางกรณี การทวงบุญคุณฮุกมฮะรอม The objectives of this research were 1) to study the background and the significance of surah al-Hujurat, 2) to study the meaning and the importance of prohibitions according to the principles of Islamic jurisprudence and (3) to make an analytical study on the prohibitions according to the principles of Islamic jurisprudence in surah al-Hujurat. This research was descriptive research by using the methods of the Usul at-Tafir (principles of the Qur'anic exegesis), Usul al-Hadith (the methodology of hadith) and Usul al-fiqh (principles of Islamic jurisprudence), Arabic grammar, al-Balagha, (Rhetoric) , Nawh (Synt ax) and Sarf (Etymology). The results showed that 1) The reasons for revelation of the al-Quran in surah al-Hujurat related to prohibited behavior of human in Islamic etiquette, such as (a) do not put yourselves before Allah and his messenger in all affairs, (b) do not raise your voices above the voice of the Prophet, (c) do not ridicule another people, (d) do not call each other by offensive nicknames, (e) do not backbite each other, (f) do not spy, and (g)do not count favors. 2) The literary styles of prohibition appeared in the al-Quran and the al-Hadith are real (Haqiqi) and metaphorical (Majazi). That does not mean the prohibitive of expression in the al-Quran and al-Hadith are strictly forbidden called "Haram". In the meantime, the literary styles of prohibition appeared in the al-Quran and al-Hadith may be disliked but not forbidden is termed "Makruh” 3) To put yourself before Allah and His messenger in all affairs are Haram. To raise one’s voice above the voice of the Prophet are Makruh. To ridicule other people are Haram. To call each other by offensive nicknames is Haram, but it is permissible to call each other by their proper names. To spy or to unmask others' weakness is Haram, but there are some exceptions to these. To backbite each other is Haram, but there are some exceptions to these as well. So count favors is to equally Haram
